The Regular Township meeting held on October 4, 2011 at 7:00 pm was called to order and opened with a Moment of Silence in Memory of Robert Onkst, Pledge of Allegiance.
Swearing in Kenneth Wertz – District Justice Paula Aigner was present to swear in appointed Supervisor Kenneth Wertz.
Roll Call of Officers
All Board members were present; Sec-Treasurer Beverly Henderson, Solicitor Frederick Gieg, Attorney Matthew Gieg, Engineer Richard Bulger, Zoning Officer Kevin Cramer were present.
Minutes
A motion was made by Kenneth Wertz and 2nd by George Henry to accept the meeting minutes of September 6 2011, September 16, 2011 September 27, 2011 and the Treasurer’s Report for the month of September was presented. The motion passed unanimously.
Announcements – There was an Executive Session held after the September 27, 2011 meeting for personnel matters.
General Comments – Residentsof Linds Crossing – Supervisor Grove stated that the residents had received a letter from Zoning Officer Kevin Cramer stating that an inspection will be conducted in their area to see if their openings are still open and also for flood compliance. The residents in question are the ones that the government raised. Zoning Officer Kevin Cramer and Engineer Bulger will be conducting the inspections.
Old Business:
James Faith Extension of Time – a request to grant the Township a 91 day extension of time was received from Keller Engineers on behalf of James Faith. After some discussion Engineer Bulger recommended that the Township accept the request granting the Township an addition 91 days to expire on January 3, 2012 Keller Engineers is still waiting for their NPDS Permit, a motion was made by George Henry and 2nd by Kenneth Wertz accepting the request. The motion passed unanimously.
Peak Flow Agreement – There is agreement between Hollidaysburg Sewer Authority and the Township that if there is an excessive amount of flow then the Sewer Authority had the right to fine the Township for excessive amount. With the help of Tom Levine and Richard Bulger they have indicated that the meter that the Sewer Authority installed was not accurately reading the flow.
After several meeting with the Sewer Authority an agreement was reached between the Sewer Authority and the Township to
a. Pay $17,400.00 for the total fines
b. No further fines will be assessed until the meters are installed.
A motion was made by George Henry and 2nd by Kenneth Wertz authorizing the approval to sign the Peak Flow Agreement.
Solicitor Report: Solicitor Gieg, Atty Matthew Gieg, James Grove and Kenneth Wertz attend a meeting that the Hollidaysburg Sewer Authority held on October 3, 2011 to inform all the Municipalities on how much the upgrade to the Hollidaysburg Sewer Plant will cost and how they are going to finance the project. Solicitor Gieg stated that they will be issuing Bonds in the amount 10,000,000.00 of which Frankstown Township is responsible for approx. 15.45% of the debt service based on the Agreement that we have in place. It must be emphasized however that the obligation itself on the bonds will be only that of Hollidaysburg which will be funded by the existing Agreement which requires our Township to pay any costs in connection with the sewer plant in this instance it will be based on the actual amortization schedule that is developed at the time the bonds are issued. It should also be noted that the date for the bond issue to close did not close based upon the recommendation of their bond counsel. In the year of 2012 the Township will have to pay $65,500.00 as an interest payment.
Solicitor Gieg also reported that he sent a letter to their Solicitor Nathan Karn to address the issue that Frankstown Township has, namely, if any of the other municipalities default on their obligation to the Hollidaysburg Sewer Authority concerning these bonds that Frankstown Township could not be called upon to make up for this default. A letter has already been written in that regard.
New Business:
Purchase of New Phone System for the Office from Morefield Comm. Under the Costar Program in the amount of $6,936.00- Solicitor Gieg stated that he reviewed the warranty and stated that the warranty is only as good as the company that you purchase the phone from, with that a motion was made by George Henry and 2nd by Kenneth Wertz. The motion passed unanimously.
Purchase of 4 to 5 Cell phone – A motion was made by George Henry and 2nd by Kenneth Wertz authorizing the purchase of the cell phones from Verizon. The motion passed unanimously.
Radio Batteries there are 5 radios that need new batteries. Since the cost of the batteries and the radios would be approximately be the same amount, with that a motion was made by James Grove and 2nd by George Henry to purchase 5 radios. The motion passed unanimously.
Supervisor Grove stated that he received a letter from Penn Dot on the US 22 Corridor Planning on Oct 12, 2011 at 5:00 PM at the Hollidaysburg Jr. High School.
Randy Isenberg reported on the following:
On behalf of the Geeseytown Fire Company welcome to the Board.
Meeting with Jim Frank from Congressman Shuster Office concerning grants for the Fire Co.
Meeting hall has been rented every weekend in October.
Dinner and Open house scheduled for Oct. 9th all are welcome
They will be testing the hoses and begin replacing what needs to be replaced.
They will be completing the Budget for year 2012 and a copy will be remitted to the Board.
Other New Business
Supervisor Grove stated that there was a hearing for the CDBG Funds, Supervisor Grove and Henry were in attendance of which the funds were to go to rehabbing residence within Frankstown Township
Report on Joseph Barry – Solicitor Gieg stated that he contacted Todd Holes for a legal description of the property, the title search was completed, a release of mortgage and the deed needs to be drafted.
A motion was made by James Grove and 2nd by George Henry to adjourned the meeting at 7:30 PM. The motion passed unanimously.
